What is AUTOCAP?

AUTOCAP is a free public service that can help resolve disputes between consumers and dealers.  Most concerns can be resolved at the dealership level, but sometimes you might need an impartial representative to help you. 

AUTOCAP can also help with any NEW or USED CAR LEMON LAW complaints.  AUTOCAP keeps up to date with constantly changing laws to provide you with the latest information.  AUTOCAP can informally mediate your disagreements through a panel of dealer and consumer representatives who will review the facts of the case and recommend a solution.

STEP 1

Always speak to someone in authority at the dealership.  If the problem involves a sales transaction, speak to the sales manager; if the problem involves a defect or the service is unsatisfactory, contact the service manager.  If you are still unsatisfied, ask to see the customer relations manager, general manager, or the dealership owner.

STEP 2

If a satisfactory solution can't be reached and the problem is with the vehicle or with the service provided by the manufacturer, contact the appropriate national zone or customer relations office.  This information should be in your owner's manual; if it isn't, your dealer should be able to provide it.

 

STEP 3

When contacting AUTOCAP, please be prepared to provide the following information:

- Vehicle information (year, make, model, mileage, etc.); the nature of the problem (sales, service, warranty, advertising, etc.)

- A brief description of the problem

- The names and titles of the people you have spoken to

- The solution you think is fair.

Once your complaint has been received, it will be forwarded to the dealer.  AUTOCAP will attempt to "mediate" the dispute by working with you and the dealer.  The majority of complaints will be resolved at this point.

Unfortunately, AUTOCAP is not effective in all situations.  AUTOCAP cannot be effective when...

- Legal action has already been taken, or you've already hired an attorney.

- The problem involves anything other than a participating member new car dealer or manufacturer.

There is no 3-day "cooling off" or return program.
